ENTerms of Service — Kenotex

By installing or using Kenotex (the "App"), you agree to these Terms of Service. If you do not agree, do not use the App.

1. The Service

Kenotex is a productivity app for macOS and iOS that provides:

• Local task, calendar, habit, and Omni Input management.
• Optional iCloud sync via your Apple ID.
• AI-powered parsing of natural-language input via our proxy at api.kenx.me.
• Optional paid features under the Kenotex Pro subscription.

The App is provided "as is" without warranty of any kind. We make no guarantees about availability, accuracy of AI-generated parsing, or fitness for any particular purpose.

2. Free Tier

Free use of the App includes:

• All local features (todos, calendar, habits, themes that are not Pro-gated).
• Up to 6 AI parsing calls per day, reset every 24 hours UTC.
• Manual parse mode in Omni Input (you must explicitly trigger each parse).

3. Kenotex Pro Subscription

3.1 What Pro Includes

• Unlimited AI parsing (subject to a fair-use ceiling to prevent abuse).
• Auto-parse mode (LLM runs automatically 800ms after you pause typing).
• Paper / Paper Ink literary themes.

3.2 Pricing & Billing

• Pro is offered as an auto-renewing subscription:
  • Monthly: priced per Apple Tier 3 (e.g., USD 2.99 / CNY 19.90; final pricing may vary by region).
  • Annual: priced per Apple Tier 25 (e.g., USD 29.99 / CNY 198.00; approximately 16% saving versus monthly).
• Payment is charged to your Apple ID at confirmation of purchase.
• Auto-renewal: subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. The cost of renewal is charged to your Apple ID within 24 hours prior to the period end.
• You can manage and cancel subscriptions through your Apple ID settings (Settings → [your name] → Subscriptions on iOS, or App Store → Account → Subscriptions on macOS), or via the in-App "Manage Subscription" link.
• Cancellation takes effect at the end of the current billing period; we do not pro-rate refunds for unused portions.

3.3 Refunds

All refunds are handled by Apple per their App Store refund policies. We have no ability to issue refunds directly. Visit reportaproblem.apple.com to request a refund.

3.4 Trial Periods

If we offer an introductory free trial, the duration and terms are disclosed on the Apple-provided purchase sheet at the time of purchase. Trials convert to paid subscriptions automatically unless cancelled before the trial ends.

4. Your Content

You retain all rights to the content you create in Kenotex (todos, notes, events, etc.). We do not claim ownership of your data.

By submitting text to the AI parsing service, you grant us a temporary, transient license to relay it to a third-party LLM provider for the sole purpose of returning a structured response. We do not retain your input after the response.

5. Acceptable Use

You agree not to:

• Reverse-engineer, decompile, or attempt to bypass the subscription or rate-limiting mechanisms.
• Use the App to process content that is illegal, harmful, or violates the rights of others.
• Submit prompts intended to extract sensitive system instructions, jailbreak the LLM, or abuse our infrastructure.
• Resell access to the Pro subscription.

We reserve the right to suspend service for accounts that violate these terms.

6. Third-Party Services

• Apple iCloud and StoreKit 2 (subject to Apple's terms).
• LLM providers located within the People's Republic of China (the App routes requests through our proxy; we do not expose your data to providers beyond what is necessary to generate the response). See Section 1.4 of our Privacy Policy for the specific providers and data-residency disclosure.

7. Service Availability & Changes

We strive to keep the App and proxy server available, but cannot guarantee uninterrupted service. We may update, modify, or discontinue features, including the AI parsing service, at any time. Material changes affecting paid subscribers will be communicated where reasonably practical.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Kai XU or Kenotex be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to data loss, loss of profits, or business interruption, arising out of your use of the App. Total liability for any claim shall not exceed the amount you paid for the subscription in the 12 months preceding the claim.

9. Termination

You may stop using the App at any time by uninstalling it. We may terminate or suspend your access to AI parsing or Pro features if you breach these terms. Upon termination, the surviving sections (Limitation of Liability, Your Content, Indemnification) remain in effect.

10. Changes to These Terms

We may revise these Terms from time to time. The "Last updated" date at the top reflects the latest revision. Continued use after revisions constitutes acceptance.

2. 免费版

本应用的免费使用包括:

• 所有本地功能(待办、日历、习惯、非 Pro 主题等)。
• 每天最多 6 次 AI 解析调用,每 24 小时(UTC)重置。
• Omni Input 中的手动解析模式(每次解析需显式触发)。

3. Kenotex Pro 订阅

3.1 Pro 包含的功能

• 无限 AI 解析(为防滥用设有合理使用上限)。
• 自动解析模式(您停止输入 800 毫秒后自动调用 LLM)。
• Paper / Paper Ink 文学主题。

3.2 价格与计费

• Pro 以自动续订订阅形式提供:
  • 月度:按 Apple 第 3 档定价(例如 USD 2.99 / CNY 19.90;最终价格可能因地区而异)。
  • 年度:按 Apple 第 25 档定价(例如 USD 29.99 / CNY 198.00;相比月度大约节省 16%)。
• 购买确认时,费用由您的 Apple ID 支付。
• 自动续订:订阅会自动续订,除非在当前周期结束前至少 24 小时关闭自动续订。续订费用会在当前周期结束前 24 小时内由您的 Apple ID 扣除。
• 您可以通过 Apple ID 设置管理与取消订阅(iOS:设置 → [您的姓名] → 订阅;macOS:App Store → 账户 → 订阅),或通过应用内"管理订阅"链接进入。
• 取消会在当前计费周期结束时生效;我们不会按未使用部分按比例退款。

3.3 退款

所有退款由 Apple 按其 App Store 退款政策处理。我们无法直接发起退款。请访问 reportaproblem.apple.com 提交退款请求。

3.4 试用期

如果我们提供首次免费试用,试用时长与条款会在购买时由 Apple 的购买面板显示。试用期结束前不取消的话,将自动转为付费订阅。

4. 您的内容

您保留对在 Kenotex 中创建的所有内容(待办、笔记、事件等)的全部权利。我们不主张对您数据的所有权。

当您向 AI 解析服务提交文本时,您授予我们一项临时的、瞬态的许可,允许我们将其转发给第三方 LLM 提供商,仅用于返回结构化响应。响应返回后我们不保留您的输入。

5. 可接受使用

您同意不进行以下行为:

• 反向工程、反编译、或试图绕过订阅或速率限制机制。
• 用本应用处理违法、有害、或侵犯他人权利的内容。
• 提交意图提取系统提示、越狱 LLM、或滥用我们基础设施的提示词。
• 转售 Pro 订阅访问权。

我们保留对违反本条款的账号暂停服务的权利。

6. 第三方服务

• Apple iCloud 与 StoreKit 2(适用 Apple 自身条款)。
• 位于中华人民共和国境内的 LLM 提供商(本应用通过我们的代理路由请求;我们不会向提供商暴露超出生成响应所必需的数据)。具体提供商及数据驻留地见隐私政策第 1.4 节。

7. 服务可用性与变更

我们努力保证本应用与代理服务器的可用性,但无法保证不间断服务。我们可能随时更新、修改、或停止某些功能(包括 AI 解析服务)。影响付费订阅用户的重大变更会在合理实际范围内进行通告。

8. 责任限制

在适用法律允许的最大范围内,Kai XU 或 Kenotex 不对因您使用本应用而产生的任何间接、附带、特殊、后果性或惩罚性损害负责,包括但不限于数据丢失、利润损失或业务中断。任何索赔的总责任不超过您在索赔前 12 个月内为订阅支付的金额。

9. 终止

您可以随时通过卸载停止使用本应用。如果您违反本条款,我们可能终止或暂停您对 AI 解析或 Pro 功能的访问。终止后,本条款中适用于终止后的部分(责任限制、您的内容、赔偿)仍然有效。

10. 条款变更

我们可能会不定期修订本条款。文首的"最近更新"日期反映最新修订。修订后继续使用即视为接受。
